The Modern concrete and glass building was constructed in 1978 and renovated in 2012. It is at Dick Street and Franklin Street. United States Highway 301 is five blocks to the east of the site. MacMillan & MacMillan are the building designers. There have been 1893 and 1926 courthouses earlier in Fayetteville, the only county seat. The county was taken from Bladen County on January 1, 1754 as the 22nd county. The county is named for the Duke of Cumberland. Fayetteville is named for Revolutionary War General Marquis de Lafayette. Cumberland County was the birthplace for 1 North Carolina Governor, Warren Winslow.

The county is in the southeast part of the state. Raleigh, North Carolina is north and Charlotte, North Carolina is west of the county. The county center is in Fayetteville 1.8 miles East of the city center. The county is surrounded clockwise by Harnett, Sampson, Bladen, Robeson, Hoke, and Moore counties.

It has a density of 508.7 persons per square mile making it 9 out of 100 in the state. Cumberland County has 72.9% of its population in its incorporated areas. Interstate Highway 95 crosses through the county from northeast to southwest from Harnett County to Robeson County. United States Highway 13 enters from Sampson County, east, and terminates. United States Highway 301 parallels Interstate Highway 95 from Harnett to Robeson counties. United States Highway 401 comes from Harnett County, north, and goes to Hoke County, southwest. The county resembles a fat plow. Fayetteville is located in the western half of the county. Fayetteville is the county seat and the largest city. It is 62.3% of the county population. This county is in the Fayetteville Metropolitan Statistical Area.
